David May was a merchant with an estate of $1,700, as recorded in the 1860 census of Pike Co., KY. During the early months of the Civil War, David was the Kentucky State Representative from Pike County, elected for a two-year term on August 5, 1861. He was a strong supporter of the movement for the state to declare allegiance to the Confederacy. This was not a popular position among the legislators and he was expelled from office on August 29, 1862 for "joining or aiding the Confederate Army." He served in the Confederate Army in the Civil War after joining on June 1, 1863 at Camp Bowen, Va. He was a Second Sergeant when he was killed about a year later during - or about the time of - the Battle of Cynthiana. Family traditions, passed down by a grandson, Lucien May, say he "was not killed by bullet or sabre, but was drowned in action," and that his widow was denied any benefits "due to the manner of her husband's death." Lucien related that the drowning occurred when a dam for a millpond was blasted open by the Union soldiers. David May's grave is marked in Battle Grove Cemetery, Cynthiana, KY. Some family members say this incident occurred somewhere between Cynthiana and Mt. Sterling.

Thomas lived with his widowed mother until her death in 1907. In 1909, at the age 56, he married Sally Little, a woman 34 years his junior, and within a few years he moved from Pike County to a farm he purchased near Winchester, KY.
